Tractor Driver Jailed for Eight Years After Fatal Crash on A40
A 61-year-old tractor driver has been sentenced to eight years in prison following a collision that claimed the life of a 26-year-old motorcyclist on the A40 in Herefordshire. Philip Baker, of Wonastow in Monmouth, Gwent, was found guilty of causing death by dangerous driving at Worcester Crown Court on July 28.
The incident occurred on August 11, 2022, just before 10pm near Ganarew in Ross on Wye. Baker was travelling towards Monmouth at less than 25mph on a road with a 70mph limit when the crash happened. The tractor and trailer he was operating had multiple safety defects, including the absence of an amber beacon, which should have alerted other road users to the vehicle's slow speed.
Safety Defects and Poor Vehicle Condition
The court heard that Baker had been drawing straw from a field before the collision. Investigators from West Mercia Police's Serious Collision Investigation Unit found that the tractor and trailer were in poor condition and overloaded with straw bales. The trailer's brakes were not functioning and were not connected to the tractor cab. The hydraulic line between the two vehicles was poorly maintained, and the lights cable was held together with baler twine.
The lack of an amber beacon meant the motorcyclist, Steven Lee, had no warning of the tractor's presence or its significantly reduced speed as he approached at normal speed.
Police Condemn Negligence Leading to Needless Loss of Life
Sgt Michael Straughan, road death lead investigator, expressed satisfaction with the sentence. He stated that the tractor and trailer were not only in poor condition but crucially were not displaying the amber hazard beacon. He noted that the lack of that beacon meant Steven was not properly alerted to its presence on the road, nor able to judge its speed properly, which would have been less than 25mph on a road with a maximum of 70mph for most road users.
This neglect resulted in the fatal collision and the needless loss of life.
